Terms of Service — MoveWitness

Last updated: September 23, 2026

These terms are the agreement between you and Baker Ventures LLC ("we," "us"), a Utah limited liability company, covering your use of the MoveWitness mobile app ("the app"). By installing or using the app, you agree to them. If you don't agree, don't use the app — deleting it ends the agreement, and there is no account to close.

How your data is handled is covered by the separate Privacy Policy.

Not legal advice

MoveWitness is a documentation tool. It records what you observed and photographed; it does not advise you, represent you, or decide anything. This is the same wording the app already prints in the footer of every report it generates, and these terms repeat it rather than restate it differently, so the two can never drift apart:

This report is a record of what was observed and photographed on the dates shown. It is not legal advice, and it does not by itself decide any security-deposit claim. Deposit rules — deadlines, itemisation and what may be withheld — vary by state and sometimes by city. Check your own state statute or ask a lawyer in your state.

As a term of this agreement:

What the integrity digest is — and is not

Every report the app generates carries a SHA-256 integrity digest computed over the report's own contents: the property label, the inspection's identifiers and timestamps, each room's name, notes and condition, the actual bytes of every photo included, and the time the report itself was generated. Because that generation time is part of what gets hashed, two exports of the same, unchanged inspection will have different digests — regenerating a report does not reproduce its earlier digest. The digest is a fingerprint of one export's exact contents at the moment it was made, not a reproducible check you can run again later to confirm the underlying facts haven't changed.

What it is not, in the app's own words, printed in that same footer:

A content digest, not a signature — it does not prove when this file was created.

Specifically, the digest is not a cryptographic signature, not a notarisation, and not a trusted third-party timestamp. It is computed on your own device, from data on your own device, with no key only we hold and no external timestamp authority involved. It therefore proves nothing to someone who does not trust that device or its clock, and it does not establish authenticity, authorship, or the time of anything. Do not present it as a signature or as proof of when a photograph was taken. (The app does read and store each photo's own EXIF capture date where the photo has one, but that metadata comes from the file you supplied and we do not verify it.)

Completing an inspection locks it: once completed, no room, note, or photo on that inspection can be added, edited, or removed through the app. That lock is a feature of this app's own data layer on your own device — it is a discipline that makes your record more credible, not a legal guarantee that no one could ever alter data by other means.

Your licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use one copy of MoveWitness on devices you own or control, to document properties you have a legitimate reason to document. That licence is all you get: we keep ownership of the app itself — its code, design, name, and report formats — and nothing here transfers any of that to you.

Your data is yours

Everything you create — properties, inspections, rooms, notes, and photos — belongs to you, and we cannot see it. MoveWitness has no account, no server, and uploads nothing; it all lives in local storage on your own device.

Acceptable use

Use MoveWitness to document property you own, rent, manage, or are otherwise entitled to be in and to photograph. Don't:

Local law may limit when and where you may photograph inside an occupied dwelling, and may require notice before entry. Those rules are yours to follow; the app does not check them for you.

Cost and purchases

MoveWitness is free. There is no subscription, no in-app purchase, no paywall, and no advertising. If that ever changes, it will change in a future version with its own terms shown to you before you buy anything — this version does not obligate you to pay for anything.

No warranty

The app is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted or error-free, that a photo, note, digest, or export will be captured, computed, or produced correctly, or that any record it holds will survive a device fault, an OS update, or your own deletion.

Limitation of liability

To the maximum extent permitted by law, Baker Ventures LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost data, lost photographs, lost deposit, unfavourable settlement, adverse ruling, or other outcome of any dispute, arising from or relating to your use of the app. Our total liability for any claim relating to the app will not exceed the greater of the amount you paid us for it (which, for this version, is nothing) or US$50.

Nothing here limits liability that cannot be limited under applicable law — including liability for fraud, or for death or personal injury caused by negligence. Some jurisdictions do not allow these exclusions, in which case they apply to you only as far as that jurisdiction permits, and you may have rights under your local consumer-protection law that these terms cannot take away.

Termination

You can end this agreement at any time by deleting the app; that also deletes your data from the device. We may stop offering, updating, or supporting MoveWitness at any time, and may suspend or terminate your licence if you breach these terms. Because everything is on your device, an installed copy keeps working even if we stop distributing it — but we are not obliged to keep it compatible with future OS versions. The sections on your data, no warranty, limitation of liability, and governing law survive termination.

Governing law

These terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws rules. Where mandatory consumer-protection law of your place of residence applies, it applies in addition to this. Nothing in this section changes the point made above that the landlord-tenant and security-deposit law governing your tenancy is your own state's, not Utah's — this clause is about this agreement, not about your lease.

Changes to these terms

We may update these terms. When we do, we'll change the "Last updated" date above and describe what changed. Material changes will be surfaced in the app. Continuing to use the app after a change means you accept the updated terms.
