3 deadlines NoticeGuard models for Indiana: what each one counts from, the statute it was read from, and the statute text.
Information, not legal advice. This app reports what the statute says and cites the section it read. It is not legal advice, it does not file anything for you, and it does not tell you what to do.
Verify with the statute or an attorney. Statutes change, and courts reinterpret them. Every deadline in this app comes from a statute read on the date shown next to its citation - that snapshot can go out of date. Missing a mechanics lien deadline can extinguish your claim permanently, so confirm any deadline you are relying on with an attorney licensed in that state before you act on it.
Data verified: statute text retrieved 2026-09-21 (each citation below carries its own date). Rule data from the NoticeGuard app, source commit 22f9300.
Original contractor, Subcontractor, Supplier, Preconstruction service only when you do not tick "This is a Class 2 structure (a building or townhouse of one or two dwelling units, or a qualifying outbuilding)"
Original contractor, Subcontractor, Supplier, Preconstruction service only when you tick "This is a Class 2 structure (a building or townhouse of one or two dwelling units, or a qualifying outbuilding)"
File the sworn statement and notice of intention to hold a lien (default)
Filed in duplicate with the county recorder, counted from this claimant's own last labor performed or materials/machinery furnished - the general 90-day period for property that is not a Class 2 structure.
What it counts from. 90 days after last furnishing (last day on site).
Applies to. Original contractor, Subcontractor, Supplier, Preconstruction service (when you do not tick "This is a Class 2 structure (a building or townhouse of one or two dwelling units, or a qualifying outbuilding)").
Indiana Code § 32-28-3-3 (a) Official source · statute text retrieved 2026-09-21
“Except as provided in subsection (b), a person who wishes to acquire a lien upon property, whether the claim is due or not, must file in duplicate a sworn statement and notice of the person's intention to hold a lien upon the property for the amount of the claim: (1) in the recorder's office of the county; and (2) not later than ninety (90) days after performing labor or furnishing materials or machinery described in section 1 of this chapter.”
If the date is missed (the statute's own terms). The statute makes timely filing a condition of the lien itself (a person "who wishes to acquire a lien... must file"); the summary-table cross-reference in § 32-28-3-6 further confirms a missed filing leaves no notice of intention to anchor a later foreclosure action.
Also stated next to this deadline.
Applies identically regardless of claimant role - contractor, subcontractor, mechanic, or supplier all file under the same § 3 clock (§ 32-28-3-1(a)). The fork is entirely about the structure type, not who the claimant is.
Anchor is this claimant's own LAST date of furnishing labor or materials/machinery, not first delivery and not a shared project-completion date.
File the sworn statement and notice of intention to hold a lien (Class 2 structure)
Filed in duplicate with the county recorder, counted from this claimant's own last labor performed or materials/machinery furnished - the shorter 60-day period for a Class 2 structure (a building or townhouse of one or two dwelling units, or a qualifying outbuilding), regardless of whether anyone occupies it.
What it counts from. 60 days after last furnishing (last day on site).
Applies to. Original contractor, Subcontractor, Supplier, Preconstruction service (when you tick "This is a Class 2 structure (a building or townhouse of one or two dwelling units, or a qualifying outbuilding)").
Indiana Code § 32-28-3-3 (b) Official source · statute text retrieved 2026-09-21
“This subsection applies to a person that performs labor or furnishes materials or machinery described in section 1 of this chapter related to a Class 2 structure (as defined in IC 22-12-1-5) or an improvement on the same real estate auxiliary to a Class 2 structure (as defined in IC 22-12-1-5). A person who wishes to acquire a lien upon property, whether the claim is due or not, must file in duplicate a sworn statement and notice of the person's intention to hold a lien upon the property for the amount of the claim: (1) in the recorder's office of the county; and (2) not later than sixty (60) days after performing labor or furnishing materials or machinery described in section 1 of this chapter.”

"Class 2 structure" (IC 22-12-1-5) is a fire-code definition - a townhouse or building/structure of one or two dwelling units (plus a qualifying outbuilding like a garage, barn, or swimming pool) - confirmed to contain no owner-occupancy requirement at all. Do not conflate this flag with the separate, narrower "owner-occupied" test used only in § 32-28-3-1(h)-(i); see `limitations`.
Applies identically regardless of claimant role - the fork is entirely about the structure type, not who the claimant is.
File a complaint to enforce the lien
Filed in the circuit or superior court of the county where the property is located, counted from the date the sworn statement and notice of intention to hold a lien was recorded.
What it counts from. 365 days after notice of construction lien recorded.
Applies to. Original contractor, Subcontractor, Supplier, Preconstruction service.
Indiana Code § 32-28-3-6 (a) Official source · statute text retrieved 2026-09-21
“A person may enforce a lien by filing a complaint in the circuit or superior court of the county where the real estate or property that is the subject of the lien is situated. The complaint must be filed not later than one (1) year after: (1) the date the statement and notice of intention to hold a lien was recorded under section 3 of this chapter; or (2) subject to subsection (c), the expiration of the credit, if a credit is given.”
If the date is missed (the statute's own terms). The statute states plainly: "if a lien is not enforced within the time set forth in subsection (a), the lien is void" (§ 32-28-3-6(b)) - a right-extinguishing deadline, not merely procedural.
Also stated next to this deadline.
Approximated as 365 calendar days (1 year), the same approximation style used throughout this app.
A narrow, formally-documented credit extension exists (§ 32-28-3-6(c)) - not modeled; this app always shows the un-extended 1-year deadline. See `limitations`.
Weekend and holiday rollover
NoticeGuard does not model a weekend or holiday extension for Indiana. The dates above are the plain count from the date you enter. Check whether a Saturday, Sunday or holiday changes your date.
What this rule set does not cover
The § 32-28-3-1(h)/(i) notice-to-owner condition precedent is NOT modeled: a 30-day notice for alteration/repair of an owner-occupied single/double dwelling, or a 60-day notice-plus-recorder-filing for original construction of a dwelling intended for owner occupancy - both apply only to a person who sells or furnishes ON CREDIT to someone other than the occupying owner. This app has no job-fact field for "sold on credit" or for the owner-occupancy status the notice itself is conditioned on, so it is left unmodeled rather than guessed. Note this is a genuinely different test from the § 3(b) Class 2 structure fork below - do not conflate the two.
Do NOT confuse "Class 2 structure" (the 60-day fork below, a fire-code structure-type test under IC 22-12-1-5: one or two dwelling units, regardless of who occupies it) with "owner-occupied" (the separate, narrower § 32-28-3-1(h)/(i) notice condition above). A landlord's duplex or a spec-built single-family house qualifies as a Class 2 structure and gets the 60-day filing period even though no owner occupies it.
The § 32-28-3-9(b) owner-liability notice for subcontractors/lessors/journeymen/laborers is NOT modeled - the statute text itself states no numeric day count for this notice (a functional trigger, "before... amount due... is subtracted," not a calendar deadline), and it creates a separate personal-liability mechanism against the owner rather than the lien itself. Distinct from the § 3 filing deadline; not modeled.
Weekend/holiday rollover is NOT modeled, and the reason is more specific than the usual "unconfirmed" gap: the commonly-assumed citation, IC 1-1-4-5, was checked directly and is a general definitions glossary (adult, attorney, bond, clerk...) containing no Saturday/Sunday/holiday language at all - the wrong statute. The actual computation-of-time statute, IC 34-7-5-1, excludes only Sunday (not Saturday or legal holidays) and by its own text applies to time periods "provided in this title" - Title 34 (Civil Procedure) - not Title 32 (Property), where Chapter 28-3 lives. Indiana Trial Rule 6(A), a court rule rather than an Indiana Code section, is what practitioners actually rely on for a broader rollover, but it was outside this app's Indiana-Code-only sourcing and was not independently verified.
The 60-day carve-out's claimant-role scope is not restricted by this app: § 32-28-3-3(a)/(b) confirmed to apply identically regardless of contractor/subcontractor/supplier role - the fork is entirely about the structure, not who the claimant is (§ 32-28-3-1(a) lists all claimant types under the same § 3 clock). The widely-repeated "60 days for subcontractors / 90 days for general contractors" framing would be wrong for Indiana and is not modeled here.
A narrow, formally-documented credit extension to the 1-year foreclosure deadline exists (§ 32-28-3-6(c): a written credit agreement signed by the lienholder and all record owners, itself recorded within 1 year of the original notice) - not modeled; this app always shows the un-extended 1-year deadline.
Only §§ 32-28-3-1, -3, -4, -6, and -9, plus the cross-referenced IC 22-12-1-5, IC 1-1-4-5, and IC 34-7-5-1, have been read. The rest of Chapter 28-3 is not incorporated.
This app generates the sworn statement and notice of intention from § 32-28-3-3(c)'s required content (no prescribed statutory form or magic words).
NoticeGuard is an app that turns a job's dates into a countdown for each statutory step, shows the statute text each date was read from, exports a calendar file (.ics) and sends reminders 14, 7 and 1 day before each deadline. It tracks and reminds; it does not file anything for you.
