2 deadlines NoticeGuard models for Rhode Island: what each one counts from, the statute it was read from, and the statute text.
Information, not legal advice. This app reports what the statute says and cites the section it read. It is not legal advice, it does not file anything for you, and it does not tell you what to do.
Verify with the statute or an attorney. Statutes change, and courts reinterpret them. Every deadline in this app comes from a statute read on the date shown next to its citation - that snapshot can go out of date. Missing a mechanics lien deadline can extinguish your claim permanently, so confirm any deadline you are relying on with an attorney licensed in that state before you act on it.
Data verified: statute text retrieved 2026-09-21 (each citation below carries its own date). Rule data from the NoticeGuard app, source commit 22f9300.
Mailed by prepaid registered or certified mail to the owner AND filed in the land evidence records of the city or town, counted from this claimant's own work performed or materials furnished - both acts must happen within this same window.
What it counts from. 200 days after last furnishing (last day on site).
Applies to. Original contractor, Subcontractor, Supplier, Preconstruction service.
R.I. Gen. Laws § 34-28-4 (a) Official source · statute text retrieved 2026-09-21
“any and all liens claimed or that could be claimed under §§ 34-28-1, 34-28-2 or 34-28-3 shall be void and wholly lost to any person claiming under those sections unless the person shall, before or within two hundred (200) days after the doing of such work or the furnishing of such materials, mail by prepaid registered or certified mail, in either case return receipt requested, a notice of intention... and also shall before or within two hundred (200) days after the doing of the work or the furnishing of the materials file a copy of the notice of intention in the records of land evidence in the city or town in which the land generally described in the notice of lien is located.”
If the date is missed (the statute's own terms). The statute's own mechanism: the lien "shall be void and wholly lost" unless both the mailing and the filing happen within the two hundred days.
Also stated next to this deadline.
Must be executed under oath and contain: the owner's (or lessee's/tenant's) name and address; a description of the land sufficient to identify it; a general description of the work/materials and their approximate value; the name and address of the person the claimant dealt with directly; the claimant's own name and address and who may sign for them; and a statement that the claimant has not been paid.
The statute prescribes an exact substantial form for this notice - see this app's generated document for this rule.
File complaint to enforce lien and notice of lis pendens
Both filed with the superior court and land evidence records respectively - the complaint on the same day as the lis pendens notice, or within 7 days after - counted from the date the notice of intention was recorded.
What it counts from. 40 days after notice of construction lien recorded.
Applies to. Original contractor, Subcontractor, Supplier, Preconstruction service.
R.I. Gen. Laws § 34-28-10 (a) Official source · statute text retrieved 2026-09-21
“Any and all liens under the provisions of § 34-28-1, 34-28-2, 34-28-3, or 34-28-7 regardless of the mailing and filing of a notice of intention under § 34-28-4 or any exemption therefrom, shall be void and wholly lost to any person claiming a lien under those sections, unless the person shall file a complaint to enforce the lien... and unless such person shall also file... a notice of lis pendens..., the complaint to be filed on the same day as the notice of lis pendens, or within seven (7) days thereafter, and both the complaint and the notice of lis pendens to be filed within forty (40) days of the date of the recording of the notice of intention.”
If the date is missed (the statute's own terms). The statute's own mechanism: the lien "shall be void and wholly lost" unless both filings happen within the forty days.
Also stated next to this deadline.
Several secondary sources describe this deadline as 120 days - that reflects an earlier version of this section; the current text (last amended by P.L. 2006, ch. 630) requires 40 days, confirmed by reading the statute directly rather than trusting a secondary summary.
Both filings are required, and the complaint specifically must be filed on the same day as the lis pendens notice or within 7 days after it - filing only one, or filing them too far apart, does not satisfy this section.
Weekend and holiday rollover
NoticeGuard does not model a weekend or holiday extension for Rhode Island. The dates above are the plain count from the date you enter. Check whether a Saturday, Sunday or holiday changes your date.
What this rule set does not cover
The alternate 30-day-from-return filing path (§ 34-28-4(a): if the mailed notice of intention is returned undelivered, the claimant may instead file it - together with the returned envelope - within 30 days of the return, so long as it is still within 200 days of the original mailing) is not modeled as a separate rule; this app always shows the standard 200-day deadline.
The retainage-specific effective period (§ 34-28-9: a notice of lien is effective as to unpaid retainage from commencement of the work, not just the 200-day look-back) is not modeled - a data-dependent variant this app does not otherwise collect a retainage fact for.
The power-of-sale suspension mechanics for a mortgaged property (§ 34-28-10(b)) are not modeled - they affect a mortgagee's rights, not the claimant's own deadline.
Weekend/holiday rollover is NOT modeled - no general Rhode Island computation-of-time statute was researched this pass.
Only §§ 34-28-4, 34-28-9, and 34-28-10 have been read. The rest of Chapter 34-28 - including the notice-of-lien content requirements referenced from § 34-28-7's exemption and the lis pendens content required by § 34-28-11 - has not been incorporated.
NoticeGuard is an app that turns a job's dates into a countdown for each statutory step, shows the statute text each date was read from, exports a calendar file (.ics) and sends reminders 14, 7 and 1 day before each deadline. It tracks and reminds; it does not file anything for you.
